1 High-Quality Development of the Belt and Road with Support from International Cooperation of Digital Economy Hot!

At present, the global digital economy has formed a development paradigm of coexistence of competition and cooperation. China actively promotes international cooperation in the digital economy. Correctly understanding and adapting to the new situation of digital economy in countries along the Belt and Road is the prerequisite for China to promote high-quality development of the Belt and Road and deepen international cooperation of digital economy. Based on the digital economy development level index of the countries along the Belt and Road, this paper analyzes the development status of the digital economy along the Belt and Road through comparative research. The results shows that the level of digital governance, the construction of digital infrastructure and the application of digital technology are three main factors that lead to differences in the development of digital economy along the Belt and Road. In the future, China should attach great importance to digital economy cooperation of key regions, deepen the connectivity of digital infrastructure along the Belt and Road, push forward more enterprises in the field of digital economy to go overseas, and share development dividend of digital economy with other countries.

11 High-Quality Development of China-Europe Rail Express and the Construction of “the Belt and Road” International Economic and Trade Cooperation Corridor System Hot!

Ever since China-Europe Rail Express opened to the public, it has developed rapidly and become the most productive trade corridor and a new international logistics public goods of “the Belt and Road” international economic and trade cooperation. However, rapid development has also brought about problems and conflicts, for instance, problems of “scattered, disorderly, and low efficiency” train operation is prominent; “excessive short supply” of transportation resources and “inefficient and wasteful use” of transportation resources coexist; comprehensive transportation costs is comparatively high; subsidies from local governments is huge; bottlenecks exist to varying degree in countries along the belt and road in terms of their infrastructure and service capacity; multilateral cooperation and coordination mechanism needs to be improved and policy support needs to be strengthened urgently; informatization and digitization of the train operation are lagging behind. With China embarking on a new journey of comprehensively building a socialist modernized country and the continuous evolution of worldwide changes of a scale unseen in a century, the high-quality development of China-Europe Rail Express is facing new opportunities and challenges. To achieve high-quality development of China-Europe Rail Express and promote the construction of “the Belt and Road” international economic cooperation and trade corridors, the following policy recommendations are put forward. First, strengthen strategic and overall planning to provide guidance for high-quality development of the Express; Second, cultivate and promote rail hubs with those distribution centers as the core and promote the optimization of train routes so as to achieve a transformation from “point to point” to “hub to hub” operation mode; Third, accelerate pace to improve the policy system for supporting train services, that is, shifting from supplementing freight rates to reducing costs, addressing shortcomings, and improving service levels, and help improve capacities; Four, further improve rail infrastructure along domestic and international routes and enhance the modernization of train services; Five, strengthen cooperation with overseas market players to further gathering international sources of goods and promote the two-way and coordinated development of the Express; Six, improve the level of digital development; Seven, accelerate the improvement of multi-level coordination mechanisms and promote win-win cooperation among the Belt and Road countries.

China-Europe Railway Express is a major innovation in the field of international railway intermodal transport, as well as a model of implementation of the “Belt and Road” initiative and a necessary link for deepening international cooperation. It has gone through several stages, including early exploration and nurturing, regular and large-scale development, integrative construction and standardization, layout transformation, and consolidation and enhancement of the quality of the development. The construction and development of China-Europe Railway Express has brought about a new situation of international transport, explored a new path of railway reform, and opened a new chapter of opening up for inland area, which is of great significance and value for enhancing the resilience of international trade and transport system, deepening the supply-side structural reform of China’s railway industry, and helping the inland areas of the Asian-European continent to better integrate into the open global economy. It provides successful experience in combining top-level design with local exploration, carrying out multi-tiered and multi-dimensional cooperation, and adhering to the mode of innovation-driven and bottom-line thinking, etc. In the future, we should implement the new development philosophy and focus on high-quality development, balance the functions of the government and the market forces and adhere to market-oriented development, strengthen coordination and linkage to enhance the coordinated development in the region, and coordinate development and safety and adhere to the diversified development. With these steps, China-Europe Railway Express will move towards higher quality, greater benefits and more safety.

28 Five Dimensions of Research on Capital Logic Hot!

Capital logic, as an unavoidable major issue in contemporary society, has aroused widespread concern in the academic circles. In interpreting capital logic, scholars have demonstrated the theoretical connotation of capital logic by centering around three explanatory approaches of “internal law theory”, “proliferation movement theory” and “dual implication theory”. Moreover, scholars have also systematically sorted out the specific manifestations of capital logic in the operation of economy, institution, awareness and power relations, and dialectically analyzed the great impact of capital logic on people’s production and life. In other words, in the “affirmative understanding” of capital promoting the development of production and the process of human civilization, they launched substantive criticism on a series of issues such as fairness and justice, life domination, unbalanced development, etc. On the basis of dialectically grasping the logic of capital, “disintegration theory” and “control theory” have become the basic strategies to deal with capital logic. Today, we still need to learn from Marx’s critical theory of capital logic so as to properly handle the problem of controlling capital to “prevent the disorderly expansion of capital” in the process of theoretical interpretation and reality practice, and open up a new situation for deepening the criticism of capitalism in the 21st century and promoting the new form of human civilization.

With the advent of the information age, the centralized and bureaucratized model of ideological and political education in higher education institutions established during the industrial age is facing challenges. In terms of mindset, there is a need to shift from bureaucratized to equal and interactive style; in terms of technological means, a transition should be made from labor-experience-driven to data-intelligence-driven; and in terms of work modes, a shift from one-way procedural approach to all-round collaborative approach is called for. 52 Formation, Analysis and Resolution of China’s National Railway Debt Risks Hot!

China’s National Railway debt is becoming a significant threat to its market-oriented reform and high-quality development. Through an analysis of the debt formation process over the past 17 years, the study reveals the following findings: The accumulation of debt shows the distinct stages. The principal causes of the mounting debt burden include the unresolved substantial historical debt, heavy investment without adequate capital to support, the idiosyncrasies of railway construction investment, and the inadequate management model for the entrusted transportation. Drawing upon the causes of debt formation and the debt risk resolution experiences both domestically and abroad, this paper proposes a phased, categorized, and multi-agent approach to resolving the debt risk in China’s National Railway. To be specific, the allocation of the historical debt should be distributed among the central finance, local finance, and China’s State Railway through the implementation of measures such as policy-driven debt-to-equity swaps, the establishment of special railway funds, and market-oriented pricing. Moreover, all relevant parties should provide the necessary support for effective resolution.

63 Study on the Evolutionary Game of Manufacturers’ Low-carbon Production Under the Dual Constraints of Government Regulation and Public Scrutiny Hot!

Using evolutionary game and numerical simulation methods, we investigate the low-carbon production behavior of the manufacturers under the dual constraints of government regulation and public scrutiny, and compare the enterprises’ decisions under static and dynamic reward-penalty mechanism.The study reveals the following finding: Under the static reward-penalty mechanism, when the constraint of public scrutiny is strong, the local governments can ensure that the enterprises choose low-carbon production by adjusting their strategies. When the constraint of public scrutiny is weak, regardless of whether the constraint of government regulation is strong or weak, they cannot ensure that the enterprises choose low-carbon production. In specific, when the constraint of government regulation is strong and the local governments’ regulatory benefits exceed regulatory costs, the probability of enterprises choosing low-carbon production oscillates. Then, if the local governments implement dynamic reward-penalty mechanism, the probability of the enterprises choosing low-carbon production will show a significant convergence trend. Moreover, when the penalty amount and reputation loss increase, the probability of the enterprises choosing low-carbon production will increase. But when the reward amount increases, the probability of low carbon production will decrease. In order to promote the low-carbon transformation of manufacturers, government regulation and public scrutiny should be further strengthened. In terms of government regulation, the dynamic reward-penalty mechanism should be implemented, with emphasis putting on penalties and supplemented by rewards.

76 From Technology M&A to Independent Innovation: The Evolution Mechanism and Path Hot!

Taking ambidextrous innovation as theoretical perspective, and applying case study method of the grounded theory, this paper explores the evolution path and mechanism of technology M&A into independent innovation and examines the innovation performance. The results show that the evolution of technology M&A into independent innovation follows the three-stage path of “secondary innovation in the technology screening period--integrated innovation in the technology transfer period--original innovation in the technology reconstruction period”. The innovative application of technology is realized through exploitive innovation, the innovative transition of technology is realized through exploratory innovation, and the ambidextrous innovation enables independent innovation. Therefore, technology M&A is not totally exclusive to independent innovation. Enterprises can achieve technology accumulation through technology M&A, and cultivate the ability of ambidextrous innovation so as to gradually evolve into independent innovation.

Being significant to strategic management and organizational theory, organizational institutionalization research has been receiving constant attention and being highly valued. By systematically sorting the development history of organizational institutionalization research, the study finds that organizational institutionalization is based on micro-foundations of institution, and is influenced by ideology and conception, and behavioral practice. It is essentially shaped by such basic elements as legitimacy, cultural penetration, practice-drive, power participation, institutional change, and technological impetus, and has the inherent motivation to expand the institutional order. Under the current context of an era of network intelligence and information big data, three major directions for future organizational institutionalization research are proposed: theoretical extendibility, linguistic turn of research methods, and big data technology as an impetus for organizational institutionalization.

Health disinformation refers to the disinformation related to medical health, which is partially deviated from the original accurate meaning (or objective reality) due to the influence of factors such as the intention of the information producer, interference from external noise, characteristics of the media and individual differences of the information receiver in the communication process. The generation of such disinformation is closely related to such factors as the quick spread of academic controversy on a certain health topic, the information producers’ lack of professional knowledge, the public’s panic or anxiety, the deliberate use by some businesses for profit and the misuse of AI intelligent writing tools. Since health disinformation is misleading, widely spread, difficult to identify, has long time-effectiveness and great harm, an effective control and management is in urgent need. While strengthening the identification through technical means, it is necessary to establish a health information governance mechanism in the internet of healthcare system and work together to create a clean health information environment; make full use of online and offline multi-channel resources to carry out medical and health knowledge popularization activities and improve the public’s ability to screen various health information; establish relevant incentive system to enhance the enthusiasm and responsibility consciousness of medical staff in information screening; release true and scientific health information in time, to increase the frequency of true health information and guide the public correctly. At the same time, we should face up to the new challenges to the dissemination of health disinformation brought by the continuous development of information technology, and adjust governance strategies timely.

111 Research on Incentive Mechanism for Cross-border E-commerce Supply Chain Collaboration Under Demand and Tax Rate Uncertainty Hot!

Considering that consumer demand is affected by the service level of cross-border e-commerce platform, Stackelberg game model is developed to study the two-level supply chain composed of product supplier and cross-border e-commerce platform, and to analyze the influence of incentive mechanism on the choice of collaboration strategy among supply chain members under the demand and tax rate uncertainty. The results show that cross-border e-commerce platform can always benefit from collaboration, while the willingness of product supplier to collaborate is contingent upon the consumers’ sensitivity to the service level of platform and the prior probability of the tax rate. When the sensitivity is moderate and the prior probability of the tax rate satisfies certain conditions, Pareto optimization can be achieved in the cross-border e-commerce supply chain, that is, an appropriate incentive mechanism can prompt product supplier to take the initiative to collaborate. Demand uncertainty and product supplier’s bargaining power positively affect the value of optimal transfer payments, and the difficulty of implementing incentive mechanism increases with the decrease of demand forecasting accuracy by cross-border e-commerce platform and the reduction of tax rate.

126 Driving Mechanism and Performance Impact of Digitalization on Omni-channel Supply Chain Integration: From Supply Chain Practice View Perspective Hot!

The digital transformation of omni-channel retailers is still in its early stage of development because of the input-output concerns. The significance of digitalization to omni-channel supply chain management have been discussed by scholars from theoretical perspective. Nevertheless, the driving mechanism and effects of digitization on omni-channel supply chain integration have not yet been fully verified. By constructing an empirical model based on the supply chain practice view, this study applies structural equation modeling to examine the questionnaire data of 188 omni-channel retailers in China. The findings demonstrate that digitalization not only propels the omni-channel supply chain integration but also encourages an increase in the firm performance through both direct and indirect effects. It also finds that the supply chain integration plays a positive mediating role between digitalization and firm performance. Therefore, firms should face up to various challenges brought about by digital transformation and achieve high-level supply chain integration through such means as the remodeling of supply chain processes and the reallocation of cross-channel resources.

137 On the Change of Circumstances in Bankruptcy Reorganization Plan Hot!

The bankruptcy reorganization plan combines the contract core of the groups’ will with the formal effectiveness of res judicata. Between the freedom and restrictions in the change of the bankruptcy reorganization plan, the doctrine of change of circumstances should be placed at the center in order to construct a comprehensive standard system of the substantive and procedure about the change of China’s bankruptcy reorganization plan. The objective situation in the change of the implementation of bankruptcy reorganization plan can cover force majeure events which has not substantial differences, and the interference of purely commercial risk factors should be resolutely ruled out. In the change of circumstances of bankruptcy reorganization plan, the parties bear the obligation of renegotiation in order to properly arrange bankruptcy rights and interests by means of private autonomy. The scope of proposers for the change of circumstances of bankruptcy reorganization plan should include bankruptcy administrators, debtors and creditors, and other interested parties. The rules of procedure for voting and approval of the original reorganization plan shall be applied and the court should conduct a substantial judicial review of the plan change in the change of circumstances of bankruptcy reorganization plan.

145 On the Theoretical Basis and the Scope of the Recourse Right for Safety-guard Duty Obligors Hot!

Article 1198 of the Civil Code stipulates the supplementary liability and the right of recourse of the safety-guard duty obligor who fails to fulfill his safety-guard duty at the time of the third party’ s direct tort. The theoretical basis of the recourse right is the unjust enrichment claim of the supplementary liability bearer to the direct tortfeasor(s) for the part beyond his own liability. Based on the balance of the interests of the parties, the legislative system and the comparative law, the scope of the recourse right should adopt the mode of full supplement plus partial recovery, that is, when the direct tortfeasor is missing or unable to pay damages, the safety-guard duty obligor has the right to recover from the direct tortfeasor for the part exceeding his share of liability after assuming all the supplementary liability. Moreover, he has the right of recovery against the third-party for the reasonable expenses and the damages arising from the settlement of the supplementary liability.
