Data Factor Rights Confirmation and Regulation： Innovative Models and the Influence Mechanisms

Abstract

The confirmation of data factor rights constitutes a pivotal institutional foundation for advancing the market-oriented allocation of data factor and unleashing the value of data. Given the unique characteristics of data factors， such as non-rivalry， derivativeness， and strong synergy， current practices in rights confirmation are confronted with dual challenges of theoretical controversies and implementation dilemmas. This paper proposes a model for the data factor rights confirmation and regulation that incorporates “behavior-based supervision” alongside “factor-based rights confirmation”. Meanwhile， it is essential to construct a supporting system that takes “promoting rights confirmation practices through practical exploration” as the fundamental principle， digital technology innovation as the practical basis， and data utilization pilot zones as the management mechanism， thus providing guarantees for data factor rights confirmation and regulation models innovation. This model can effectively advance the practice of data factor rights confirmation， break down obstacles to data circulation， optimize the benefit distribution mechanism， improve the security governance framework， promote the market-oriented data factor allocation， and further unleash the value of data factors.
